RESOLUTION AUTHORIZING AN AWARD CONTRACT TO ACULABS FOR THE PERIOD OF APRIL 1, 2024, THROUGH MARCH 31, 2025 WITH FOUR (4), ONE (1) YEAR OPTIONS TO RENEW IN THE AMOUNT OF THIRTY FIVE THOUSAND AND 00/100 ($35,000) DOLLARS FOR THE PERIOD APRIL 1, 2024 THROUGH MARCH 31, 2025, AS AUTHORIZED BY N.J.S.A. 40A:11-4.1 ET SEQ.

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, N.J.S.A. 40A:11-4.1 authorizes the County to utilize competitive contracting in lieu of public bidding for procurement of specialized goods and services, the price of which exceeds the bid threshold; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4.3, the Board approved Resolution R20170872, dated October 24, 2017, authorizing the solicitation of Laboratory Services for Preakness Healthcare Center as a competitive contract; and
WHEREAS, on January 9, 2024, the Purchasing Agent unsealed responses received to RFP-24-012 for Laboratory Services for the Passaic County Preakness Healthcare Center; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4.5(d), in a Memorandum, dated January 31, 2024, which is attached hereto and made a part of this Resolution, the proposals submitted were reviewed and ranked based on a methodology for the awarding of competitive contracts, which included technical, management, and cost related criteria; and
WHEREAS, in accordance with the said Memorandum, the review committee is recommending an award of contract to Aculabs for a period April 1, 2024 through March 31, 2025 with four (4), one (1) year options to renew - thirty five thousand and 00/100 ($35,000.00) dollars for the period April 1, 2024 through March 31, 2025; and
WHEREAS, pursuant to N.J.S.A. 19:44A-20.4, the County’s request for proposals is a fair and open process, specifically, the request for proposals for Laboratory Services for the Passaic County Preakness Healthcare Center is publicly advertised, awarded under a process that provides for public solicitation of qualifications, established the basis of an award and disclosure process documented in writing prior to any solicitation, and is publicly opened and announced when awarded; and
WHEREAS, funds are available in Account No. 4-01-27-172-001-M01, in the amount of thirty five thousand and 00/100 ($35,000.00) dollars or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2021 and/or subsequent years’ County budget(s), which is attached to and made part of this Resolution; and
WHEREAS, this matter was discussed at the February 6, 2024, meeting of the Health and Human Services Committee and is being recommended to the Board for approval;
NOW THEREFORE, LET IT BE RESOLVED pursuant to N.J.S.A. 40A:11-4.1 et seq., Board of County Commissioners of the County of Passaic (hereafter “Board”) hereby authorizes the award contract to Aculabs for the period April 1, 2024 through March 31, 2025 with four (4), one (1) year options to renew in the amount of thirty five thousand and 00/100 ($35,000.00) dollars for the period April 1, 2023 through March 31, 2025; a
LET IT BE FURTHER RESOLVED the Clerk to the Board of County Commissioners of the County of Passaic (hereafter “Board”) shall print in the official newspaper a brief notice stating the nature, duration, service, and amount of the contract to Aculabs and maintain a copy of the Resolution on file and available for public inspection in the Office of the Clerk to the Board.
LET IT BE FURTHER RESOLVED that the County officials are authorized to take any other steps necessary to carry out the purpose of this Resolution.
