RESOLUTION AUTHORIZING THE PASSAIC COUNTY DEPARTMENT OF SENIOR SERVICES, PARA-TRANSIT DIVISION, TO DONATE ONE (1) 2013 FORD E-450 SENATOR SII NO LONGER NEEDED FOR PUBLIC USE TO THE CITY OF CLIFTON, PURSUANT TO N.J.S.A. 40:20-1

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, pursuant to Article VIII, Section III, Paragraph 2 of the New Jersey Constitution, counties are permitted to donate personal property no longer needed for the public use, provided that the gift serves a benefit to the community as a whole, and the recipient of the gift engages in roles related to the function of government; and
WHEREAS, the Passaic County Department of Senior Services, Para-Transit Division, has identified a 2013 Ford E-450 Senator SII (VIN 1FDFE4FS5DDA62886) that is no longer needed for public use by the Para-Transit Division; and
WHEREAS, the Passaic County Department of Senior Services, Para-Transit Division, desires to donate said 2013 Ford E-450 to the City of Clifton, as the donation of said vehicle will assist their municipal senior transportation program, and the recipient of the donation, as a municipal entity, engages in roles related to the function of government; and
WHEREAS, this matter was discussed at the December 2, 2025, meeting of the Health and Human Services Committee and is being recommended to the Board approval; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners of the County of Passaic hereby authorizes the donation of a 2013 Ford E-450, no longer needed for public use, to the City of Clifton.
LET IT BE FURTHER RESOLVED, that the authorized signatory for the City of Clifton, or his designee, Director of the Board of County Commissioners, County Administrator, County Counsel, Clerk of the Board, Chief Financial Officer, and any other employee for the County of Passaic may take any action necessary to effectuate the purpose of this Resolution.
