RESOLUTION REJECTING ALL BIDS RECEIVED FOR THE EXTERIOR RESTORATION OF THE US CUSTOMS HOUSE IN THE CITY OF PATERSON, PER BID C-26-007, PURSUANT TO N.J.S.A. 40A:11-13.2 (a), ET SEQ.

WHEREAS, the County of Passaic (hereafter “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners for the County of Passaic (hereafter “Board”) is vested with decision making powers on behalf of the County; and
WHEREAS, on March 12, 2026, the Purchasing Agent issued Bid No. C-26-007, Exterior Restoration of the US Customs House and Post Office aka the Passaic County Courthouse Annex (hereafter “C-26-007”) seeking sealed proposals from qualified bidders to restore the exterior of the US Customs House a/k/a the Passaic County Courthouse Annex in the City of Paterson; and
WHEREAS, on April 16, 2026, the Purchasing Agent unsealed responses to C-26-007; and
WHEREAS, pursuant to N.J.S.A. 40A:11-13.2(a) the Board may reject all bids wherein the lowest bid substantially exceeds the cost estimates for the goods and services; and
WHEREAS, Director of the Department of Cultural & Historic Affairs is recommending that the bids under C-26-007 be rejected in accordance with the law because the bids received substantially exceeded the available project budget; and
WHEREAS, this matter was discussed at the July 29, 2026 meeting of the Public Works Committee, and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A 40A:11-13.2(a) that the Board of County Commissioners of the County of Passaic rejects all the bids received under C-26-007, Exterior Restoration of the US Customs House and Post Office aka the Passaic County Courthouse Annex, as recommended by the Director of the Department of Cultural & Historic Affairs.
LET IT BE FURTHER RESOLVED, that the Clerk to the Board, County Counsel, Director of the Board of County Commissioners, Director of the Department of Cultural & Historic Affairs, and Purchasing Agent are authorized to take any other steps necessary to carry out the purpose of this Resolution.
