RESOLUTION AUTHORIZING PURCHASE OF BLOOD CONTROL TRAINING CLASSES BY THE PASSAIC COUNTY OFFICE OF EMERGENCY MANAGEMENT,

PURSUANT TO N.J.S.A. 40A:11-10, ET SEQ

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and

 

WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and 

 

WHEREAS, the Passaic County Office of Emergency Management (hereafter “OEM”) has requested to purchase Blood Control Training Classes for the Passaic County First Responders in an amount not to exceed fifteen thousand dollars ($15,000.00); and

 

WHEREAS, said purchase will be funded by the FY-22 UASI Homeland Security Grant; and

 

WHEREAS, Passaic County is part of the Urban Area Security Initiative (UASI) program as defined by the New Jersey State Department of Homeland Security, which includes among other public entities, Morris County; and

 

WHEREAS, N.J.S.A. 17:12-1A.5 requires that the public entity follow the procurement procedures as set forth by the New Jersey Division of Local Government Services, Department of Community Affairs (hereinafter “DCA”); and

 

WHEREAS, DCA has issued Local Finance Notice 2009-20, which sets forth the way in which training for homeland security, law enforcement and public safety, may be purchased by a local government when using a Homeland Security Grant as the funding source; and

 

                     WHEREAS, one of the approved forms of procurement when utilizing Homeland Security Grant funds is to purchase under any other County’s existing contract, as long as the same terms and conditions apply, with the approval of the initiating county and vendor, with the automatic approval of the Director of Local Government services, so long as the aforementioned terms are met; and

 

                     WHERAS, on behalf of all UASI Counties, Morris County issued Bid #21-26 for the training classes sought, and awarded the contract to the lone bidder, Penn Tactical Solutions, by Resolution, #2020-930 dated November 23, 2020; and

 

                     WHEREAS, funds are available in account number G-01-41-846-022-223 or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2024 and/or subsequent years’ County budget(s), which is attached to and made part of this Resolution; and

 

WHEREAS, this matter has been reviewed by the Law and Public Safety meeting and is being recommended to the Board for approval.

 

                     NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 17:12-1A.5 and Local Finance Notice 2009-20 the Board of County Commissioners of the County of Passaic hereby authorize the purchase of Blood Control Training Classes for the Passaic County First Responders from Penn Tactical Solutions, LLC, in an amount not to exceed fifteen thousand dollars ($15,000.00).

 

LET IT BE FURTHER RESOLVED, that the terms of the agreement with Penn Tactical Solutions, LLC, shall be identical to those in the contract awarded by Morris County as set forth in Local Finance Notice 2009-20.

 

LET IT BE FURTHER RESOLVED, that the Purchasing Agent and all other necessary officers and employees be and hereby are authorized and directed to take such further actions and sign such documents as are necessary to effectuate the purpose of this resolution, including but not limited to issuance of appropriate Purchase Orders.
