RESOLUTION AUTHORIZING THE COUNTY TO EXECUTE AN EASEMENT AGREEMENT WITH PSE&G FOR THE INSTALLATION OF A NEW GAS SERVICE AT 10 IVY STREET IN THE BOROUGH OF POMPTON LAKES, PURSUANT TO N.J.S.A. 40A:12-5

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and

 

WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and

 

WHEREAS, the County is the fee simple owner of 10 Ivy Street in the Borough of Pompton Lakes commonly known as Block 2300, Lots 1 & 7 (hereafter the “Property”); and

 

WHEREAS, PSE&G is a public utility of the State of New Jersey, engaged in furnishing utility service to subscribers in the State of New Jersey; and

 

WHEREAS, PSE&G seeks to install a new gas service to serve the backup generator for the cell tower on the Property (hereafter the “Project”); and

 

WHEREAS, in order to move forward with the Project, PSE&G must acquire an easement from the County; and

 

WHEREAS, the County has agreed to convey an easement approximately twenty (20) feet wide and one hundred twelve (112) feet long for an area of two thousand three hundred thirty-five (2,335) square feet (0.054 acres) to PSE&G; and

 

WHEREAS, the Passaic County Engineer recommending that the Board authorize the execution of an easement agreement, granting PSE&G an easement in perpetuity for its use, occupancy and enjoyment and the use, occupancy and enjoyment of its licensees, successors in interest and assigns, in connection with the provision of utility service thereto and for the conduct of its business, all in accordance with the provisions set forth in the Grant of Easement, attached hereto and made a part hereof; and

 

WHEREAS, this matter was discussed at the June 4, 2025 meeting of the Public Works Committee, and is being recommended to the Board for approval.

 

NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:12-5, that the Board of County Commissioners of the County of Passaic hereby authorize the execution of an Easement Agreement between the County of Passaic and PSE&G, granting PSE&G an easement in accordance with the provisions set forth in the Grant of Easement.

 

LET IT BE FURTHER RESOLVED, the Director of the Board of County Commissioners, Clerk of the Board and County Counsel are hereby authorized to execute a Grant of Easement on behalf of Passaic County.
