RESOLUTION AUTHORIZING THE ADVERTISEMENT OF A SUBSTANTIAL AMENDMENT TO THE PASSAIC COUNTY ANNUAL ACTION PLANS FOR FY 2022 AND FY 2023 AND A PUBLIC HEARING TO BE HELD ON FEBRUARY 16, 2024, TO PERMIT PUBLIC COMMENTS, PURSUANT TO 24 CFR 91.105.

WHEREAS, the Passaic County Board of County Commissioners (hereafter “Board”), on September 9, 2008, passed Resolution R-08-760 which adopted the Passaic County Citizen Participation Plan (hereafter “Plan”) under 24 CFR 91.105, for the Community Development Block Grant Program (hereafter “CDBG”); and
WHEREAS, the Board, on August 16, 2016, adopted Resolution R-2016-701 amending the Plan for the CDBG Program to comply with recent US Housing and Urban Development (hereafter “HUD”) regulations to include the Affirmatively Furthering Fair Housing Final Rule requirements found at 24 CFR 91.105 and 24 CFR 5; and
WHEREAS, the Plan was further amended by Resolution R-2017-0505 on July 12, 2017, to comply with added outreach requirements for Broadband access and emergency management supplemented to 24 CFR 91.105; and
WHEREAS, the Plan was further amended by Resolution R-2020-0438 on May 19, 2020, to incorporate language related to community access to program information and to permit public hearings to be held electronically in times of emergency as well as follow HUD guidance on shortened public review times during times of emergencies; and
WHEREAS, the Department of Planning and Economic Development (hereafter “Department”) seeks to advertise a substantial amendment to the Passaic County Annual Action Plans for Fiscal Years 2022 and 2023 to permit funding allocated to the Borough of Bloomingdale (FY 2022: $90,000 and FY 2023: $60,000) to be reprogrammed for the Reconstruction of the Bloomingdale Senior Center Floor which has buckled and has created a public safety hazard; and
WHEREAS, the Council of the Borough of Bloomingdale adopted Resolution R-23-12.21 requesting the substantial amendment to the Passaic County Community Development Block Grant Program Annual Action Plans for FY 2022 and FY 2023 to reprogram the grant awards to the Borough of Bloomingdale for a new project: Reconstruction of Bloomingdale Senior Center Floor; and
WHEREAS, the Department seeks to hold a public hearing to solicit comments from the public on the amended Annual Action Plans for CDBG FY 2022 and CDBG 2023 on February 16, 2024, 12:00 p.m. at 401 Grand Street Paterson, NJ 07505, Rom 417 and virtually via WebEx link attached hereto; and
WHEREAS, the Department seeks to advertise, note attached public notice, the availability of the amended scope of work for the CDBG Annual Action Plans for FY 2022 and FY 2023 that will be on public display for a 30-day period from January 29, 2024, to February 28, 2024, in order to permit the public time to comment on the proposed amendments; and
WHEREAS, this matter was discussed at the January 10, 2024, meeting of the Planning and Economic Development Committee and is being recommended to the Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to 24 CFR 91.105, that the Board of County Commissioners of the County of Passaic (hereafter “Board”) hereby authorizes the action of the Department of Planning and Economic Development as set forth above; and
LET IT BE FURTHER RESOLVED, that the Board hereby authorizes the Department to advertise the proposed amendment to the CDBG FY 2022 and FY 2023 Annual Action Plans that has been placed on public display at 401 Grand Street, Paterson, NJ 07505, Room 417; in the offices of the Board of County Commissioners, 2nd floor; and on the County website, www.passaiccountynj.org as detailed above and in the attached public notice.
