RESOLUTION AUTHORIZING ENDORSEMENT OF PROPERTY OWNER CERTIFICATION FOR NJDEP PERMIT APPLICATION FOR THE NEW STREET RESERVOIR DRAINAGE IMPROVEMENT PROJECT AT GARRET MOUNTAIN RESERVATION, PURSUANT TO N.J.S.A. 40:20-1.

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, the Passaic Valley Water Commission (hereinafter “PVWC”) proposes to undertake the New Street Reservoir Drainage Improvement Project within Garret Mountain Reservation to reduce the risk of reservoir contamination from park runoff during significant rain events; and
WHEREAS, the proposed improvements include construction of a landscape berm within the park to attenuate runoff and allow sediment to settle prior to entering the reservoir; and
WHEREAS, the County of Passaic and PVWC will enter into a shared service agreement providing for ongoing maintenance of the drainage improvements; and
WHERAS, the work requires submission of an NJDEP permit application and a Property Owner Certification from the County of Passaic endorsing PVWC’s application for work on County-owned parkland; and
WHEREAS, the County Engineer recommends approval of the endorsement and related authorizations; and
WHEREAS, this matter was discussed at the April 15, 2026 meeting of the Public Works Committee and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, that pursuant to N.J.S.A. 40:20-1, the Passaic County Board of County Commissioners hereby authorizes the endorsement of the property owner certification endorsing PVWC’s application for work on County-owned parkland
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, and Director of the Board of County Commissioners are hereby authorized to execute the agreements and take any other steps necessary to carry out the purpose of this Resolution.
