RESOLUTION AUTHORIZING THE DONATION OF ONE (1) SURPLUS POLICE VEHICLE FROM THE PASSAIC COUNTY SHERIFF’S OFFICE TO THE PROSPECT PARK POLICE DEPARTMENT, PURSUANT TO N.J.S.A. 40A:11-36(2)

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, pursuant to N.J.S.A. 40A:11-36(2), a contracting unit need not advertise for bids when it makes any such sale to the United States, the State of New Jersey, another contracting unit, any body politic to which it contributes tax-raised funds, any foreign nation which has diplomatic relations with the United States or any governmental unit in the United States; and
WHEREAS, the Prospect Park Police Department, as another contracting unit, has made an inquiry into the availability of any surplus of vehicles that could be transferred to their agency for undercover work in accordance with N.J.S.A. 40A:11-36(2); and
WHEREAS, the PCSO has identified a 2013 Ford Explorer -Vin# 1FM5K8AR5DGA68492 that has come to the end of its usefulness to the County and is available for said transfer; and
WHEREAS, the PCSO seeks approval of the Board to accomplish same; and
WHEREAS, this matter has been reviewed by the Law and Public Safety Committee on February 18, 2025, and is being recommended to the Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, that the Board of County Commissioners of the County of Passaic hereby authorizes the Passaic County Sheriff’s Office to transfer a 2013 Ford Explorer -Vin# 1FM5K8AR5DGA68492 that has come to the end of its usefulness, to the Prospect Park Police Department, pursuant to N.J.S.A. 40A:11-36(2).
LET IT BE FURTHER RESOLVED, that the Sheriff or his designee, Director of the Board of County Commissioners, County Administrator, County Counsel, Clerk of the Board, Chief Financial Officer, and any other employee for the County of Passaic may take any action necessary to effectuate the purpose of this Resolution.
