RESOLUTION AUTHORIZING EXECUTION OF AN AGREEMENT BETWEEN THE COUNTY OF PASSAIC AND MANCHESTER UTILITIES AUTHORITY FOR REIMBURSEMENT TO THE COUNTY FOR THE COST ASSOCIATED WITH REPLACEMENT AND INSTALLATION OF WATER MAINS OWNED BY MANCHESTER UTILITIES AUTHORITY AT HIGH MOUNTAIN ROAD CULVERT NO. 1600-338 IN THE BOROUGH OF NORTH HALEDON, PURSUANT TO N.J.S.A. 40:20-1 ET SEQ.

WHEREAS, the County of Passaic (hereafter “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and

 

WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners for the County of Passaic (hereafter “Board”) is vested with decision making powers on behalf of the County; and 

 

WHEREAS, the County is in the final design stages of the Replacement of the High Mountain Road Culvert No. 1600-338 in the Borough of North Haledon (hereafter “Project”); and

 

WHEREAS, the Manchester Utilities Authority’s existing sixteen (16) inch and eight (8) inch ductile iron pipes at the crossing of the First Brook at the High Mountain Road Bridge are a vital component of the Borough’s Water System; and

 

                     WHEREAS, the Manchester Utilities Authority is responsible for the maintenance of the aforementioned water mains underneath High Mountain Road and in close proximity to the High Mountain Culvert No. 1600-338; and

 

                     WHEREAS, upon the replacement of the aforementioned water mains by the County, the Manchester Utilities Authority has agreed to reimburse the County for the cost associated with the installation of the replacement pipes within ninety (90) days after the project closeout; and

 

                     WHEREAS, the Passaic County Engineer is recommending that the Board authorize an agreement between the County and Manchester Utilities Authority, whereby the County agrees to replace the aforementioned pipes and the Manchester Utilities Authority agrees to reimburse the County the costs associated with such replacement; and

 

                     WHEREAS, this matter was discussed at the January 15, 2025 meeting of the Public Works Committee, and is being recommended to the Board for approval; and

 

                     NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40:20-1 et seq., the Board of County Commissioners of the County of Passaic hereby authorizes the execution of an agreement between the County of Passaic and the Manchester Utilities Authority whereby the County agrees to replace the aforementioned pipes underneath High Mountain Road and in close proximity to the High Mountain Culvert No. 1600-338 and the Manchester Utilities Authority agrees to reimburse the County the costs associated with such replacement.

 

                     LET IT BE FURTHER RESOLVED that the Clerk of the Board, County Counsel, and Director of the Board of County Commissioners of the County of Passaic are authorized to take any other steps necessary to carry out the purpose of this resolution.
