RESOLUTION AUTHORIZING THE CERTIFICATION OF ADDITIONAL FUNDS FOR HOUSEHOLD HAZARDOUS WASTE COLLECTION EVENTS CONDUCTED IN SEPTEMBER AND NOVEMBER OF 2024 PURSUANT TO THE COUNTY’S CONTRACT WITH MXI ENVIRONMENTAL SERVICES LLC UNDER SB-23-003

WHEREAS, the County of Passaic (“County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners of the County of Passaic (“Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, the Passaic County Department of Health, Division of Recycling and Natural Resources Division coordinates all solid waste and recycling planning functions on behalf of the County and its municipalities; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4, et.seq., for every contract awarded by the County for the provision or performance of any goods or services, the cost of which in the aggregate exceeds the bid threshold established pursuant to N.J.S.A. 40A:11-3, shall be awarded by resolution of the Board to the lowest responsible bidder after public advertising for bids and bidding therefore; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4, et.seq., the Passaic County Purchasing Agent issued SB-23-003, Household Hazardous Waste (“HHW”) Collection Days for the County of Passaic (“SB-23-003”), which solicited pricing from qualified vendors to conduct HHW collection drives in the County; and
WHEREAS, on January 4, 2023, the Passaic County Purchasing Agent opened bid proposals responsive to SB-23-003, and thereafter, the Solid Waste & Recycling Programs Manager reviewed the responsive proposals to determine the lowest bidder; and
WHEREAS, pursuant to Resolution R-23-0087, dated February 14, 2023, the Board authorized an award of contract to MXI Environmental Services, LLC, d/b/a Maumee Express, Inc., (“MXI”), for a three (3) year term commencing on January 1, 2023 and expiring on December 31, 2025, in an amount not to exceed two hundred ninety two thousand two hundred ninety two and 00/100 ($292,292.00) dollars with a one (1) year option to renew; and
WHEREAS, the County previously certified a lesser amount than needed for the above-described contract because it was awaiting the receipt of entitlement funds from the New Jersey Department of Environmental Protection; and
WHEREAS, now that the County has received said funds from the New Jersey Department of Environmental Protection, the Solid Waste and Recycling Program Manager is requesting a resolution certifying additional funds as follows: sixteen thousand five hundred seventy-nine and 00/100 dollars ($16,579) for the HHW collection event conducted on September 15, 2024, and forty-four thousand eight hundred ninety-nine and 00/100 dollars ($44,899.00) for the HHW collection event conducted on November 23, 2024, for a total amount of sixty-one thousand four hundred seventy-eight and 00/100 dollars ($61,478.00); and
WHEREAS, the above-described HHW collection events were conducted on September 15, 2024, and November 23, 2024, and the County previously certified a lesser amount than needed due to awaiting the receipt of entitlement funds from the New Jersey Department of Environmental Protection; and
WHEREAS, funds are available in Account No. G-01-41-761-022-213 or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2025 and/or subsequent years’ County budget(s); and
WHEREAS, pursuant to N.J.S.A. 52:32-60-1, et seq., MXI executed the Non-Involvement in Prohibited Activities in Russia or Belarus Certification, attached hereto and made part of this Resolution, certifying it is not involved in prohibited activities in Russia and Belarus, and the County confirmed that said vendor is not identified on the Specially Designated Nationals and Blocked Persons list created by the Office of Foreign Assets Control; and
WHEREAS, this matter was discussed at the March 4, 2025, meeting of the Health and Human Services Committee and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, that the Board of County Commissioners of the County of Passaic (hereafter “Board”) authorizes the certification of additional funds in the total amount of sixty-one thousand four hundred seventy-eight and 00/100 dollars ($61,478.00) to cover HHW collection events conducted pursuant to the County’s contract with MXI Environmental Services, LLC (“MXI”) under SB-23-003.
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, and Director of the Board are authorized to execute the contract and take any other steps necessary to carry out the purpose of this Resolution.
