RESOLUTION AUTHORIZING THE COUNTY OF PASSAIC TO ENTER INTO AN INTERGOVERNMENTAL AGREEMENT WITH THE CITY OF PATERSON AND THE COUNTY OF BERGEN REGARDING THE ADMINISTRATION OF THE RYAN WHITE COMPREHENSIVE AIDS RESOURCE EMERGENCY ACT.

WHEREAS, the County of Passaic (“County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and

 

WHEREAS, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners of the County of Passaic (“Board”) is vested with managing the property, finances, and affairs of the County; and

 

WHEREAS, the Department of Health Services (“Department”) is responsible for protecting and promoting the health of approximately 525,000 County residents; and

 

WHEREAS, the United States Congress enacted the Ryan White Comprehensive AIDS Resource Emergency (“CARE”) Act on August 18, 1990, which has since been amended and updated over the years to meet the changing needs of people with HIV by providing financial assistance to states and other public and private nonprofit entities for the development, organization, coordination, and operations of more effective and cost-efficient systems for the delivery of essential services to individuals and families with HIV disease; and

 

WHEREAS, the Ryan White CARE Act is administered by the United States Department of Health and Human Services, Health Resources and Services Administration HIV/AIDS Bureau (“HAB”), which has designated the counties of Passaic and Bergen collectively as a Transitional Grant Area (“TGA”) disproportionately affected by the HIV/AIDS epidemic and therefore, eligible to apply for grant funding; and

 

WHEREAS, the governmental agencies within a TGA are expected to cooperate pursuant to the provisions of an intergovernmental agreement, and pick an entity to administer the grant funding as well as devise a comprehensive plan to serve the needs of persons infected with AIDS/HIV; and

 

WHEREAS, the County previously entered into an agreement with the County of Bergen and the City of Paterson for the administration of Ryan White CARE Act grant funding for a two-year term, and the parties desire to renew this arrangement for a successive two-year period under the same terms and conditions, as set forth in the Intergovernmental Agreement attached hereto and made a part of this Resolution; and

 

WHEREAS, this matter was discussed at the September 30, 2026 meeting of the Health and Human Services Committee, and is being recommended to the Board for approval.

 

NOW, THEREFORE, LET IT BE RESOLVED, the Board of County Commissioners of the County of Passaic authorizes the execution of the attached Intergovernmental Agreement with the County of Bergen and the City of Paterson regarding the administration of Ryan White CARE Act grant funding.

 

                     LET IT BE FURTHER RESOLVED, that the Clerk to the Board, Director of the Board, County Counsel, and Director of the Department are authorized to take any actions necessary to carry out the purpose of this Resolution.
