RESOLUTION AUTHORIZING A SUBSTANTIAL AMENDMENT TO THE PASSAIC COUNTY ANNUAL ACTION PLAN FOR FY 2021 TO PERMIT THE BOROUGH OF POMPTON LAKES TO CHANGE THEIR SCOPE OF WORK TO THE HERSHFIELD STREET RECONSTRUCTION PROJECT FUNDED UNDER CDBG FY 2023 AND PROVIDE A NO-COST TIME EXTENSION OF THE FY 2021 GRANT UNTIL AUGUST 31, 2025, PURSUANT TO 24 CFR 91.105.

WHEREAS, the Passaic County Board of County Commissioners (hereafter “Board”), on September 9, 2008, passed Resolution R-08-760 which adopted the Passaic County Citizen Participation Plan (hereafter “Plan”) under 24 CFR 91.105, for the Community Development Block Grant Program (hereafter “CDBG”); and
WHEREAS, the Board, on August 16, 2016, adopted Resolution R-2016-701 amending the Plan for the CDBG Program to comply with recent US Housing and Urban Development (hereafter “HUD”) regulations to include the Affirmatively Furthering Fair Housing Final Rule requirements found at 24 CFR 91.105 and 24 CFR 5; and
WHEREAS, the Plan was further amended by Resolution R-2017-0505 on July 12, 2017 to comply with added outreach requirements for Broadband access and emergency management supplemented to 24 CFR 91.105; and
WHEREAS, the Plan was further amended by Resolution R-2020-0438 on May 19, 2020, to incorporate language related to community access to program information and to permit public hearings to be held electronically in times of emergency as well as follow HUD guidance on shortened public review times during times of emergencies; and
WHEREAS, the Plan was further amended by Resolution R-24-194 on February 27, 2024, to permit public hearings to be held in-person and virtually in a simultaneous manner; and
WHEREAS, the Department of Planning and Economic Development (hereafter “Department”) advertised a substantial amendment to the Passaic County Annual Action Plan for Fiscal Year 2021 to permit funding allocated to the Borough of Pompton Lakes (FY 2021: $60,000) to be reprogrammed for the Hershfield Street Reconstruction project (Ackerman Place and Midland Avenue and on Ackerman Place between Federal Hill Road and Short Street. Census Tract 196403, Block Group 2 also funded under CDBG FY 2023 ($80,000); and
WHEREAS, the CDBG FY 2021 grant to the Borough of Pompton Lakes will be provided a no-cost time extension to complete the project until August 31, 2025, in order to coordinate with the work performed under the CDBG FY 2023 grant; and
WHEREAS, the Council of the Borough of Pompton Lakes adopted Resolution R-24-72 requesting the substantial amendment to the Passaic County Community Development Block Grant Program Annual Action Plan for FY 2021 to reprogram the grant award to the Borough of Pompton Lakes for the Hershfield Street Reconstruction project; and
WHEREAS, the Department held a public hearing to solicit comments from the public on the amended Annual Action Plan for CDBG FY 2021 on March 1, 2024, 12:00 p.m. at 401 Grand Street Paterson, NJ 07505, Room 417 in-person and simultaneously virtually via WebEx link and no comments were received; and
WHEREAS, the Department in accordance with the published public notice, made the amended scope of work for the CDBG Annual Action Plan for FY 2021 available on public display for a 30-day period from February 14, 2024, to March 15, 2024, in order to permit the public time to comment on the proposed amendment; and
WHEREAS, this matter was discussed at the March 13, 2024, meeting of the Planning and Economic Development Committee and is being recommended to the Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to 24 CFR 91.105, that the Board of County Commissioners of the County of Passaic (hereafter “Board”) hereby authorizes the action of the Department of Planning and Economic Development as set forth above; and
LET IT BE FURTHER RESOLVED, that the Board hereby authorizes the Department to implement a substantial amendment to the CDBG FY 2021 Annual Action Plan and provide a no-cost time extension of the CDBG FY 2021 grant until August 31, 2025, as detailed above to fund the Hershfield Street Reconstruction project.
