RESOLUTION AUTHORIZING AN AWARD OF CONTRACT TO RFS COMMERCIAL, INC., TO INSTALL NEW FLOORING AT VARIOUS COUNTY INSTITUTIONS, PURSUANT TO N.J.S.A. 40A:11-10.

WHEREAS, the County of Passaic (the “County”) is a government body incorporated pursuant to N.J.S.A. 40:18-1, et seq. and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners for the County of Passaic (hereinafter the “Board”) are vested with decision making powers on behalf of the County; and
WHEREAS, pursuant to N.J.S.A. 40A:11-10, the governing bodies of two or more contracting units may provide by a joint agreement for the provision of the performance of goods and services to be used by their respective jurisdictions; and
WHEREAS, by virtue of Resolution R20190912 dated October 8, 2019, the County entered into the Hunterdon County Educational Services Commission, which awarded a contract for Commercial Floor Covering & Related Services, 34-HUNCCP #215, to multiple vendors, including RFS Commercial, Inc.; and
WHEREAS, RFS Commercial, Inc., provided a quote to the Passaic County Engineer to install new flooring in various locations at the Passaic County Courthouse at 77 Hamilton in the City of Paterson, as well as the first floor of the Administration Building, and the Board of Social Services office in the Borough of Ringwood, in an amount not to exceed ninety-nine thousand seven hundred ninety-seven dollars and sixty-three cents ($99,797.63) attached to and made part of this resolution, which is being recommended for approval by the Superintendent of Buildings and Grounds; and
WHEREAS, funds are available in Account No. 5-01-44-900-003-002 or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2025 and/or subsequent years’ County budget(s), which is attached to and made part of this Resolution; and
WHEREAS, this matter was discussed at the March 26, 2025 meeting of the Public Works Committee and is being recommended to the Board for approval; and
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-10, the Board of County Commissioners of the County of Passaic is authorizing an award of contract to RFS Commercial, Inc., to install new flooring at various County institutions, in an amount not to exceed ninety-nine thousand seven hundred ninety-seven dollars and sixty-three cents ($99,797.63) as recommended by the Superintendent of Buildings and Grounds.
LET IT BE FURTHER RESOLVED, that Resolution No. R-25-341 dated April 8, 2025 shall be and hereby is repealed.
LET IT BE FURTHER RESOLVED, that the Director of the Board of County Commissioners, the Clerk to the Board, County Counsel, and Purchasing Agent are authorized to execute an agreement and take any other steps necessary to carry out the purpose of this resolution.
