RESOLUTION APPROVING THE BID RECEIVED FROM HANNUM’S MT HOLLY SALES D/B/A LIBERTY HARLEY DAVIDSON FOR THE PASSAIC COUNTY SHERIFF’S DEPARTMENT BID # SB-24-025 PURSUANT TO N.J.S.A 40A: 11-4, ET SEQ.

WHEREAS, the County of Passaic (hereafter “County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (hereafter “Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, the Passaic County Sheriff’s Department (hereafter “PCSD”) has requested the purchase of four (4) 2023 or Newer Harley Davidson FLHTP Electra Glide Police Motorcycles; and
WHEREAS, pursuant to N.J.S.A. 40A:11-4, et seq., for every contract awarded by the County for the provision or performance of any goods or services, the cost of which in the aggregate exceeds the bid threshold established pursuant to N.J.S.A. 40A:11-3, shall be awarded by resolution of the Board to the lowest responsible bidder after public advertising for bids and bidding thereof; and
WHEREAS, the Passaic County Purchasing Agent issued SB-24-025 Bid Purchase of Four (4) 2023 or Newer Harley Davidson FLHTP Electra Glide Police Motorcycles and Four (4) Harley Davidson Motorcycle Trade-in for the Passaic County Sheriff’s Department (hereinafter “SB-24-025”), in compliance with N.J.S.A. 40A:11-4, et seq.; and
WHEREAS, the responses for SB-24-025 were reviewed by representatives of the Sheriff’s Department who are recommending the lowest net bidder, Hannum’s Mt. Holly Sales d/b/a Liberty Harley Davidson (“Liberty HD”), be awarded the contract, for an amount not exceed one hundred and three thousand three hundred and seven dollars and eighty cents ($103,307.80); and
WHEREAS, the bid from Liberty HD consisted of a price per motorcycle in an amount of thirty-two thousand eight hundred and twenty-six dollars and ninety-five cents ($32,826.95) for a total amount of one hundred and thirty-one three hundred and seven dollars and eighty cents ($131,307.80) with a reduction of twenty-eight thousand dollars ($28,000.00) for the trade in of four (4) motor cycles, for a total net cost of one hundred and three thousand three hundred and seven dollars and eighty cents ($103,307.80); and
WHEREAS, pursuant to N.J.S.A. 40A:11-23 the County issued bid # SB-24-025 advertisement for bids which was published in advance of the date fixed for receiving the bids to promote competitive bidding; the County received bids for SB-24-025 on January 17, 2024; and
WHEREAS, funds are available account T-22-56-850-012-801 or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2024 and/or subsequent years’ County budget(s), which is attached to and made part of this Resolution; and
WHEREAS, this matter was reviewed by the Law and Public Safety Committee and is being recommended to the full Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED pursuant to N.J.S.A. 40A:11-4, et seq., the Board of County Commissioners of the County of Passaic is authorizing a contract award to Hannum’s Mt. Holly Sales d/b/a Liberty Harley Davidson, for an amount not exceed one hundred and three thousand three hundred and seven dollars and eighty cents ($103,307.80) for the purchase of four (4) 2023 or Newer Harley Davidson FLHTP Electra Glide Police Motorcycles for use by the Passaic County Sheriff’s Office; and
LET IT BE FURTHER RESOLVED, that the Clerk to the Board, County Counsel, and Director of the Board of County Commissioners of the County of Passaic are authorized to execute an agreement and take any other steps necessary to carry out the purpose of this resolution.
