RESOLUTION AUTHORIZING AN AWARD OF CONTRACT TO IMMEDICENTER TOTOWA D/B/A TOTOWA PRIMARY CARE CENTER TO PERFORM ANNUAL MEDICAL SURVEILLANCE EXAMINATIONS FOR HAZMAT TRAINED STAFF, PURSUANT TO N.J.S.A. 40A:11-5

WHEREAS, the County of Passaic (“County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners of the County of Passaic (“Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, the Department of Health Services (“Department”) is responsible for protecting and promoting the health of approximately 525,000 residents from 16 Municipalities in the County; and
WHEREAS, pursuant to 29 C.F.R. 1910.120(f), certain Department employees who may be exposed to health hazards in their course of work are required to undertake annual medical surveillance examinations known as HAZMAT physicals; and
WHEREAS, pursuant to N.J.S.A. 40A:11-5(1)(a)(i), any contract, the amount of which exceeds the bid threshold, may be negotiated and awarded by the Board without public advertising for bids and bidding therefor and shall be awarded by resolution of the Board if the subject matter of the contract is for professional services; and
WHEREAS, the Health Officer received a quote from Immedicenter Totowa d/b/a/ Totowa Primary Care Center to perform nineteen (19) HAZMAT physicals for employees of the Department for a total amount not to exceed six thousand eight hundred and ninety-seven dollars ($6,897.00); and
WHEREAS, the Health Officer has advised that Immedicenter Totowa d/b/a/ Totowa Primary Care Center is qualified to provide perform the above-described medical surveillance examinations, and is recommending the award of a contract to Immedicenter Totowa d/b/a/ Totowa Primary Care Center, as a necessary expenditure to comply with Occupational Safety and Health Administration guidelines and to ensure the health and safety of Department employees; and
WHEREAS, pursuant to N.J.S.A. 52:32-60.1, et seq., Immedicenter Totowa d/b/a/ Totowa Primary Care Center executed the Non-Involvement in Prohibited Activities in Russia or Belarus Certification, attached hereto and made part of this Resolution, certifying that it is not involved in prohibited activities in Russia and Belarus, and the County confirmed that Immedicenter Totowa d/b/a/ Totowa Primary Care Center is not identified on the Specially Designated Nationals and Blocked Persons list created by the Office of Foreign Assets Control; and
WHEREAS, funds are available in Account No. T-20-56-870-025-801 or any other account that may be deemed appropriate by the Chief Financial Officer or his designee, and the availability of funds has been contingently certified by the Chief Financial Officer subject to sufficient funds being appropriated by the Board in the 2026 and/or subsequent years’ County budget(s), which is attached to and made part of this Resolution; and
WHEREAS, this matter was discussed at the May 27, 2026, meeting of the Health and Human Services Committee and being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-5, the Passaic County Board of County Commissioners authorizes the award of a contract to Totowa Immedicenter d/b/a/ Totowa Primary Care Center to perform nineteen (19) HAZMAT physicals for employees of the Department, for a total amount not to exceed six thousand eight hundred and ninety-seven dollars ($6,897.00).
LET IT BE FURTHER RESOLVED, the Clerk to the Board shall publish on the Public Notices page of the County’s website, a brief notice stating the nature, duration, service, and amount of the contract to Immedicenter Totowa d/b/a/ Totowa Primary Care Center, and maintain a copy of this resolution on file and available for public inspection in the Office of the Clerk to the Board.
LET IT BE FURTHER RESOLVED, that the Clerk of the Board, County Counsel, Director of the Department/Health Officer, and Director of the Board are authorized to take any action necessary to carry out the purpose of this resolution.
