RESOLUTION RECOGNIZING A VENDOR CHANGE FROM CROWN CASTLE FIBER LLC TO FIBER ASSET CO., LLC, FOR CONTRACT AWARDED UNDER STATE CONTRACT NO. 22-TELE-80913, PURSUANT TO N.J.S.A. 40:20-1.

WHEREAS, the County of Passaic (“County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and

 

WHEREAS, pursuant to N.J.S.A. 40:20-1, the Board of County Commissioners of the County of Passaic (“Board”) is vested with managing the property, finances, and affairs of the County; and

 

WHEREAS, pursuant to N.J.S.A. 40A:11-12, the County may, without advertising for bids, or having rejected all bids obtained pursuant to advertising thereof, purchase any goods or services under any contract(s) for such goods and services entered into on behalf of the State of New Jersey, Department of the Treasury, Division of Purchase and Property; and

 

WHEREAS, Crown Castle Fiber LLC was awarded State Contract No. 22-TELE-80913 for T1776 Data Communications Network Services, including internet services, by the State of New Jersey, Department of the Treasury, Division of Purchase and Property; and

 

WHEREAS, on November 18, 2024, the Board passed Resolution No. R-24-986, awarding a contract for the provision of 10 Gbps internet service to the County’s data center at 495 River Street in Paterson to Crown Castle Fiber LLC for a term from November 1, 2024 to July 31, 2029, in accordance with State Contract No. 22-TELE-80913; and

 

WHEREAS, Crown Castle Fiber LLC’s fiber business was recently acquired by Fiber Asset Co., LLC dba Zayo, and the County has been informed by the State’s Division of Purchase and Property that State Contract No. 22-TELE-80913 is being assigned to Zayo, and that Zayo is authorized to provide services under this state contract; and

 

WHEREAS, for procurement and purchasing purposes, the County wishes to acknowledge this change in vendor and affirm that the contract originally awarded to the Crown Castle Fiber LLC pursuant to State Contract No. 22-TELE-80913 shall henceforth be performed by Zayo; and

 

WHEREAS, pursuant to N.J.S.A. 52:32-60.1, et seq., Zayo executed the Non-Involvement in Prohibited Activities in Russia or Belarus Certification, attached hereto and made part of this Resolution, certifying that it is not involved in prohibited activities in Russia and Belarus, and the County confirmed that Zayo is not identified on the Specially Designated Nationals and Blocked Persons list created by the Office of Foreign Assets Control; and

 

WHEREAS, this matter was discussed at the September 30, 2026 Administration and Finance Committee meeting, and is being recommended to the Board for approval.

 

NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40A:11-4.1, et seq., the Board of County Commissioners of the County of Passaic recognizes a change in vendor for the contract awarded by Resolution No. R-24-986 under State Contract No. 22-TELE-80913, from Crown Castle Fiber LLC to Fiber Asset Co., LLC dba Zayo, due to the assignment by the State’s Division of Purchase and Property of State Contract No. 22-TELE-80913 to Zayo, and affirms that this contract shall henceforth be performed by Zayo for the remainder of the contract term.

 

LET IT BE FURTHER RESOLVED, that the Clerk to the Board, County Counsel, County Administrator and Director of the Board are authorized to take any action necessary to carry out the purpose of this Resolution.
