RESOLUTION AUTHORIZING A LEASE AGREEMENT BY AND BETWEEN THE COUNTY OF PASSAIC AND THE PASSAIC COUNTY IMPROVEMENT AUTHORITY FOR THE BANDWIDTH ON THE COUNTY’S FIBER-OPTIC NETWORK, PURSUANT TO N.J.S.A. 40:20-1

WHEREAS, the County of Passaic (“County”) is a body politic and corporate pursuant to N.J.S.A. 40:18-1 and vested with all rights contained therein; and
WHEREAS, pursuant to N.J.S.A. 40:20-1 the Board of County Commissioners of the County of Passaic (“Board”) is vested with managing the property, finances, and affairs of the County; and
WHEREAS, pursuant to the County Improvement Authorities Law, N.J.S.A. 40:37A-44, et seq., the Board created the Passaic County Improvement Authority (“PCIA”); and
WHEREAS, the County has a private fiber-optic network that allows the County to offer hi-speed internet connectivity, email services, security cameras, offsite backup and disaster recovery, and wireless hot spots to municipalities and school districts at a diminished price compared to the private market; and
WHEREAS, the County is interested in exploring the expansion of these services to the County’s residents and businesses, and desires to enter into a partnership and lease agreement with the PCIA, under which the County will lease an agreed amount of bandwidth on its fiber-optic network to the PCIA for residential and commercial use; and
WHEREAS, this matter was discussed at the July 29, 2026, meeting of the Administration and Finance Committee and is being recommended to the Board for approval.
NOW, THEREFORE, LET IT BE RESOLVED, pursuant to N.J.S.A. 40:20-1 that the Board of County Commissioners of the County of Passaic authorizes a lease agreement with the Passaic County Improvement Authority, under which the County will lease an agreed amount of bandwidth on its fiber-optic network to the PCIA for residential and commercial use.
LET IT BE FURTHER RESOLVED, that the Clerk to the Board, County Administrator, County Counsel, and Director of the Board are authorized to take all action necessary to carry out the purpose of this Resolution.
